Elon Musk’s AI War With OpenAI Explained As Rift Intensifies, Lands In Court
Elon Musk, one of the world’s most well-known tech leaders, is now in a serious legal fight with OpenAI. Musk, the CEO of Tesla and xAI, co-founded OpenAI, which is an artificial intelligence company, a decade ago. However, he later parted ways with the company, stating that it was merely a money-making venture.
The Musk company, xAI, filed a lawsuit against OpenAI, accusing it of stealing important technology from xAI. They also claimed that OpenAI is secretly hiring away key employees of xAI. This case is the biggest battle between two tech giants.
Musk Says OpenAI “Cheated”
In September 2025, Musk’s company, xAI, filed a lawsuit in California. The complaint alleges that OpenAI conducted a “coordinated, unfair, and unlawful campaign” to acquire xAI’s proprietary technology.
This includes source code, training methods, and how xAI builds and runs its data centers. The lawsuit uses strong language, stating that “By hook or by crook, OpenAI clearly will do anything when threatened by a better innovator, including plundering and misappropriating the technical advancements, source code, and business plans of xAI.”
Musk also posted publicly on X that “We sent them many warning letters, but they continued to cheat. Lawsuit was the only option after exhausting all others.”
What xAI Claims Happened
The lawsuit names several former xAI employees, including engineers Xuechen Li and Jimmy Fraiture. It says OpenAI offered them large payments and then took confidential files with them. According to the filing:
- Xuechen Li allegedly “uploaded the entire xAI source code base to a personal cloud account” in July 2025.
- He later “admitted in a handwritten confession” that he took code and training materials.
- Jimmy Fraiture allegedly used AirDrop “at least five times” to transfer xAI’s code after signing with OpenAI.
One unnamed finance executive who left xAI for OpenAI reportedly said that “The data center team. Their speed and precision blew me away. I would NEVER want to compete against them.”

OpenAI Responds to Its “Baseless” and “Harassment”
OpenAI strongly denies the claims. On October 2, the company filed a motion to dismiss the lawsuit. A spokesperson told Forbes that “This latest filing is consistent with Mr Musk’s ongoing pattern of harassment.”
OpenAI states that it did not steal any code or secrets and that its employees are free to change jobs. The company also claims that xAI is attempting to divert attention away from its own issues.
Apple Pulled Into the Fight
xAI also filed a separate lawsuit against Apple. In this lawsuit, xAI says it worked with OpenAI to block competition in the App Store. Musk claims Apple is making it “impossible for any AI company besides OpenAI to reach #1 in the App Store.”
The lawsuit says Apple and OpenAI are “manipulating the App Store rankings to cause the X and Grok apps to perform worse, and delaying reviews of updates to the Grok app.”
Apple has not commented directly, but OpenAI responded that “We have no tolerance for any breaches of confidentiality, nor any interest in trade secrets from other labs.”
A Long History of Tension
Musk helped start OpenAI in 2015 as a nonprofit organization focused on the development of safe AI. He left the board in 2018, saying it conflicted with Tesla’s work on self-driving cars.
Since then, he has criticized OpenAI for becoming a for-profit company and partnering with Microsoft.
Earlier in 2025, Musk offered $97.4 billion to buy OpenAI. The board rejected the offer, saying the company was not for sale.
What Experts Say
Legal experts say the case will depend on proof. Navodaya Singh Rajpurohit, legal partner at Coinque Consulting, said that “Hiring alone is rarely enough to prove trade-secret misuse. Whether it crosses into unlawful misappropriation will depend on evidence not included in the filing.”
Battle Between Musk & OpenAI Will Decide Who Controls The Future Of AI
Musk’s chatbot Grok is built into Tesla cars and the X app. Millions use OpenAI’s ChatGPT, and it is now part of Apple’s iPhones. The lawsuit says, “ChatGPT is the only generative AI chatbot that benefits from billions of user prompts originating from hundreds of millions of iPhones.” Musk wants xAI to be seen as a more open and innovative alternative. OpenAI states that it is focused on responsible and healthy development, and the company denies all claims of wrongdoing.
It is expected that a trial will happen in early 2026. Until then, the battle between the two companies will continue, keeping the future of AI at stake.
